Terms of Service

These Terms of Service ("Terms") govern your use of BopChat, an iMessage app for sending pictures that disappear after they are viewed. BopChat is provided by AIx Solutions Group, Inc. ("BopChat", "we", "us"). By using BopChat, you agree to these Terms. If you do not agree, do not use the app.

Eligibility

You must be at least 13 years old to use BopChat. By using the app, you represent that you meet this requirement and that you are able to form a binding agreement with us.

The service

BopChat lets you send a picture inside an iMessage conversation that is intended to be viewed and then disappear. We may change, suspend, or discontinue any part of the service at any time.

Your content

You are solely responsible for the pictures and other content you send through BopChat. You retain ownership of your content. You grant us a limited, non-exclusive license to store, process, and transmit your content only as needed to deliver it to your intended recipient and operate the service. You represent that you have the right to send the content you send and that doing so does not violate the law or anyone else's rights.

Acceptable use

You agree not to use BopChat to create, send, or store any content or to engage in any conduct that:

is unlawful, or that sexually exploits or endangers a minor in any way (we have zero tolerance for child sexual abuse material and will report it to the appropriate authorities, including the National Center for Missing & Exploited Children);
contains intimate or explicit images of a person shared without that person's consent;
harasses, threatens, defames, or invades the privacy of another person;
infringes intellectual property or other rights;
contains malware, or attempts to disrupt, overload, or gain unauthorized access to the service; or
reverse engineers, scrapes, or abuses the service or its underlying systems.

We may remove content and suspend or terminate access for anyone who violates these Terms.

Disappearing pictures are not a guarantee of secrecy

BopChat is designed so that pictures are viewed and then disappear, but we cannot prevent a recipient from capturing a picture, for example with a screenshot or by using another device or camera. Do not send anything you would not want to be captured, saved, or shared.

No warranty

BopChat is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error free, or secure, or that any picture will be delivered, viewed, or deleted at any particular time.

Limitation of liability

To the fullest extent permitted by law, AIx Solutions Group, Inc. and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of BopChat. Our total liability for any claim relating to the service will not exceed one hundred US dollars ($100).

Termination

You may stop using BopChat at any time. We may suspend or terminate your access to the service at any time, with or without notice, including for any violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. You agree that any dispute relating to these Terms or the service will be resolved in the state or federal courts located in that jurisdiction.

Changes

We may update these Terms from time to time. When we do, we will revise the effective date above and post the updated Terms on this page. Your continued use of BopChat after a change means you accept the updated Terms.
